1Quality Standards

Samway Global aims to coordinate production according to the product specification, approved sample, purchase order and other written requirements agreed with the customer.

Quality requirements must be clearly established before production wherever reasonably possible.

2Customer Specifications

Customers are responsible for providing accurate and complete specifications.

These may include:

  • dimensions
  • materials
  • colours
  • tolerances
  • finishes
  • packaging
  • labelling
  • branding
  • functionality
  • testing requirements
  • other relevant quality requirements

Samway Global is entitled to rely on the customer’s approved specifications and samples.

3Product Samples

Where samples are produced, customers should carefully inspect and approve them before production.

Once a customer approves a sample or specification, production may proceed based on the approved characteristics.

Minor variations that are commercially reasonable and normal within the relevant manufacturing process may occur.

4Pre-Shipment Inspection

Where agreed, Samway Global may arrange a pre-shipment inspection (“PSI”) before goods are loaded for shipment.

Inspection may be carried out by an independent inspection company such as:

  • SGS
  • Bureau Veritas
  • Intertek
  • another suitable independent inspection provider

5Inspection Scope

The inspection scope will depend on the requirements agreed for the particular order.

An inspection may include checks relating to:

  • quantity
  • appearance
  • dimensions
  • workmanship
  • packaging
  • labelling
  • functionality
  • other agreed inspection criteria

6Inspection Costs

Unless otherwise agreed, inspection costs are payable by the customer.

Additional inspections may result in additional charges, particularly where they are required because of:

  • a failed inspection
  • production changes
  • customer-requested re-inspection
  • shipment delays
  • other circumstances outside Samway Global’s responsibility

7Inspection Results

An inspection report may state whether the goods meet the agreed inspection criteria.

A “Passed” inspection means that the goods met the agreed inspection criteria at the time and within the scope of the inspection.

A passed inspection is not an absolute guarantee that every individual product is free from every possible defect.

8Customer Approval

Where customer approval is required following inspection, the customer should provide approval promptly.

Failure to provide timely approval may cause production or shipment delays.

9Loading and Shipment

Following a satisfactory inspection and customer approval where applicable, goods may proceed to loading and shipment.

Once goods have been approved for shipment, later claims concerning matters that were reasonably identifiable during the agreed inspection may be subject to the applicable commercial agreement.

10Defects Not Reasonably Identifiable During Inspection

Claims concerning genuine latent defects that could not reasonably have been identified during the agreed inspection should be notified promptly after discovery.

Customers should preserve the affected goods and provide appropriate evidence where requested.

11Manufacturer Responsibility

Where products are manufactured by an independent third-party manufacturer, the manufacturer remains responsible for manufacturing according to the agreed production requirements.

Samway Global may assist the customer in communicating quality issues to the manufacturer.

12Quality Claims

Where a quality issue is reported, Samway Global may request:

  • photographs
  • videos
  • inspection reports
  • product samples
  • batch information
  • packaging information
  • shipping documentation
  • other evidence reasonably required to investigate the issue

13Remedies

Where a quality claim is established, the available remedy may include:

  • replacement
  • repair
  • rework
  • credit
  • refund
  • price adjustment
  • another commercially reasonable remedy

The appropriate remedy will depend on the nature and extent of the issue and the applicable commercial agreement.

14No Absolute Quality Guarantee

Samway Global coordinates quality-control procedures but cannot guarantee that every product manufactured by an independent third-party supplier will be completely free from defects.

Nothing in this policy excludes or limits any liability or legal right that cannot lawfully be excluded or limited.
